1- Acquiring of land in view to building
The acquisition of new land is formalised at first by signing a private
pre-contract, followed by the signing of a duly authenticated bill of sale
as soon as any possible suspensive conditions have been removed (acquisition
of a building permit for example).
Pre-contract
This document has been prepared by SAEM
Sophia Antipolis Côte dAzur as authorised agent.
If there is no suspensive clause, the signature of the pre-contract
must be signed and the down payment of 40% of the land price not
including land taxes be made. In other cases, this percentage
may be negotiated. As soon as the pre-contract has been signed
the company may go ahead with geological surveys, which are necessary
for the reconnaissance of the ground. The company may, moreover,
continue procedures in its own right for the filing of the preliminary
request for land clearance with the DDAF as well as the building
permit. The regulations for the

specifications are attached to the transfer.
The authenticated bill of sale
This comes into action up to 6 months after the signature of the
pre-contract on the initiative of the seller. The total of the sale price
plus the required VAT is paid on the day of the signature of the bill
of sale. The bill of sale can be taken, as the case may be, in administrative
form and without fees.
Building Permit
The request for a building permit to the Commune (District) is done
as soon as the pre-contract is signed in order to obtain the preliminary
authorisation for the corresponding land clearance.
The time allowed for technical regulation is between two and four months.
